Complaint Comments:
Modern Family Insurance Company, failed to pay sales tax on total loss/agreed value claim. In accordance with PA title 31, 62.3 section (b) In addition to the requirements in the act, the appraisal shall contain a written disclosure which includes the following: (7) Applicable sales tax. DOI has stated in past that Insurance Company policy can not supersede PA state law. Modern Family claims a limit of liability in declaration, states that vehicle deemed constructive total loss, they will pay agreed value. They do not state in their policy, less sales tax on agreed value. It is my firm belief that the DOI should follow law and confirm a positive settlement of this claim, once again Insurance Company policy can not supersede PA state law.
