TJ Kehoe was here to inspect the loss vehicle, which was vandalized, on May 22, 2006. The left front door was damaged at the front due to the side mirror striking it. There was also damage to the rear edge of the same door which Mr. Kehoe felt was prior damage. He added the prior damage to the entire estimate of vandalism damage, and then prepared a "related prior damage" estimate for the damage to the back of the left front door. When he did this, however, he eliminated many procedures needed to repair the damage due to the vandalism. The way that he included the two sets of damage and then deducted the prior damage is so convoluted that it is difficult to ascertain how some of the deducted times were arrived at. However, even disregarding any partial deductions in times for certain procedures, the insured was not indemnified for the vandalism damage by $349.16. When I objected to Mr. Kehoe that he was over-deducting for the unrelated damage, he refused to recalculate his estimate, saying it was State Farm's policy to do what he did. While State Farm has the right to not pay for unrelated damage, they must pay their insured for the full amount of the loss sustained. State Farm is lowering their loss exposure at the expense of their insured. I have an almost identical complaint against State Farm that was lodged as Insurance Department file # 06-125-17018, but, aside from Len D'Amico calling me on 4-17-06 to get a clarification of this confusing issue, no additional action or investigation has been forthcoming to the best of my knowledge.
