Complaint Comments:
The claimant's vehicle in this loss is a 1994 Pontiac Firebird. The vehicle is well kept and has 48,647 miles on it. The vehicle was damaged down the entire left side, and has been repainted on that side. The paint needs to be color sanded and buffed to replicate the existing finish and texture of the vehicle. Nationwide came out on two supplements, but refused to pay for the procedure, saying they needed to see that the procedure was necessary. I called for a third supplement to address only that portion of the claim after the car was painted and out of the spray booth. I showed Beth Walcome from Nationwide that there was some dirt and orange peel that needed to be sanded and buffed out. She agreed that there was a difference, but said she was not permitted to pay for the procedure. She called me later in the day and asked if Jim Russell would be permitted to view the car.'I consented to the inspection, and Mr. Russell arrived later and viewed the vehicle. Although he agreed that if the car was not sanded and buffed it would be possible to tell that the car was refinished, he refused to pay for the procedure. It is ironic that Nationwide gave us and the claimant a form letter saying that PA state law requires an appraisal to include all procedures necessary to "return a loss vehicle to its function and appearance prior to the accident". By its own admission Nationwide refuses to do this.
