Complaint Comments:
Mr. Panichelli inspected the loss vehicle in reponse to a supplement request for color sand and polish and to remove the material cap that triggered my complaint on this same claim dated 10-4-06. We showed Mr. Panichelli the vehicle's refinished panels and showed him the original panels that were not refinished so he could see the reason the procedure was needed. We also showed him panels that were sanded but not yet polished, and panels that were sanded and polished so that he could see all the parts of the operation and why they were needed. The loss vehicle is a 2006 Toyota Land Cruiser with 706 miles on it, so there was no question of making the vehicle better than its original condition. In addition we showed him a Nationwide appraisal done in our shop less than a month ago where the appraiser wrote to color sand and polish the loss vehicle (a 1994 Mercedes Benz). He agreed that the procedure was necessary, and admitted that the other Nationwide appraiser wrote for the procedure but refused to pay for the procedure saying that Nationwide does not pay other shops in the area to perform that procedure. In addition he refused to remove the material cap for no logical reason. The Appraisers Act demands that an appraisal contain all the procedures, parts, and materials necessary to bring a loss vehicle back to its pre-damaged condition. In this instance, despite acknowledging the need for the procedures we performed on the loss vehicle, Nationwide refused to list them or pay for them on the appraisal. In addition, Mr. Panichelli did not perform an independent appraisal which is a violation of the act. Finally, Nationwide continues to flagrantly disregard the statute regulating appraisals by putting material caps in place and refusing to pay for necessary procedures.
