UNJUST ENRICHMENT - Allstate Insurance Company is directing their staff appraisers to take a 5% - 10% arbitrary discount on parts required to repair a consumer's damage vehicle to pre-loss condition. This discount is an unfair claims practice for which Allstate Insurance Company is being unjustly enriched. Allstate Insurance was investigated for this practice in the past and told to stop. The Pa Department of Insurance needs to be aware that Allstate is violating the following sections of the Motor Vehicle Physical Damage Appraisers Act and The Unfair Claims Settlement Pa Code Title 31, 146.6. We have included a copy of the original appraisal for your investigation. Please investigate our allegations and demand a review of all appraisals written by Allstate Insurance Company over the past 5 years and demand the insurance company properly reimburse consumers for their underpayments.'' Compliance With The Act : An Appraiser Must " Conduct himself in such a manner as to inspire public confidence by fair and honorable dealings. Approach the appraisal of damaged property without prejudice against, or favoritism toward, any party involved in order to make fair and impartial appraisals. Disregard any efforts on the part of others to influence his judgment in the interest of the parties involved. Prepare an independent appraisal of damage. Unfair Claims Settlement 146.6 When the insurer elects to repair in a first-party claim, the insurer shall cause the damaged automobile to be restored to its condition prior to the loss at no additional cost to the claimant other than as stated in the policy and within a reasonable period of time. The insurer may not use as a basis for cash settlement with a first-party claimant an amount which is less than the amount which the insurer would pay if repairs were made, other than in total loss situations, unless the amount is agreed to by the insured or provided by the insurance policy or insurance contract.
