Update: as per our conversation on 8/20 I received all the requested info that Empire auto parts and Continental auto parts will not service us because of return rate, I explained to Progressive that they will not come here they know this and confirmed but still consider these parts available. They are knowingly not listing available parts for us to purchase like we spoke about. On 6/21/2019 Vincent Mucci was out to inspect the damages to Mrs. Garbrah's X5 that his insured damaged, he listed several aftermarket parts from 2 different vendors. The parts were ordered the same day and one of the vendors never sent the parts, we had a supplement for additional damages and at this time he called the vendor and they said that we rejected the part. This statement is untrue the driver never stopped with the part so on 7-9 we ordered the part again and nothing showed again this time i was informed from Vinny that the vendor is no longer delivering to our location. Vinny is refusing to change the part to a vendor that will come here, the vendor does not make the part they simply sell the part that the aftermarket manufacturer makes just as an auto dealer would for the brand they represent. I can get aftmermarket parts from another vendor but they will not opt into this so they are sticking the claimant with a financial burden, this is in direct violation of Subchapter A. UNFAIR CLAIMS SETTLEMENT PRACTICES 146.8. Standards for prompt, fair and equitable settlements applicable to automobile insurance.(f) When the insurer elects to repair in a first-party claim, the insurer shall cause the damaged automobile to be restored to its condition prior to the loss at no additional cost to the claimant other than as stated in the policy and within a reasonable period of time.
