Department of Insurance: PROGRESSIVE INSURANCE COMPANY CLAIMS SUPERVISOR MICHAEL J. CHADWICK AND PROGRESSIVE APPRAISER JARED WILLIAM UNRUH are in violation of the Pa. Motors Physical Damage Appraiser Act and Regulation - Please investigate the following market conduct and behavior of Progressive Insurance Company employees. On June 21, 2014 our customer contacted progressive Insurance Company and requested Progressive Insurance evoke his rights to appraisal as per his insurance contract with Progressive Insurance. The reason our customer was forced to evoke his appraisal rights is that Progressive Insurance Company has denied final payment for repairs that resulted from an impact to the rear of his vehicle while driving which blew out his rear glass and damaged the surrounding body panels. We have included for your investigation a copy of our customer's letter to a Mr. Michael Chadwick the Eastern Pa Repair Manager of Progressive. Mr. Chadwick has advised our customer that Progressive Insurance Company will not honor his request for appraisal due to the fact the repairs have been completed. As per the Progressive Appraisal Clause it is stated "If we cannot agree with you on the amount of a loss, then we or you may demand an appraisal of the loss." Progressive's appraisal clause does not state the repairs cannot be completed only the amount of the loss. Our customer's vehicle has been waiting for a resolution on the amount owed for the repairs however Progressive Insurance refuses to recognize his rights to appraisal.
