Complaint Comments:
Department of Insurance: On July 6, 2015 our repair facility was contacted by an Allstate staff appraiser Mr. Gordon Kozicki #139905 who advised he was assigned to inspect our customer's vehicle for a supplemental. A previous Allstate appraiser had prepared an estimate for $2,418.36, which was underwritten. Once in the shop we prepared a proper repair order and requested Allstate to re-inspect the loss. Mr. Kozicki signed in at our facility at 2:15pm and requested our repair order which included a copy of our Contract to Repair / Repair Authorization signed by our customer. Mr. Kozicki took our information and went about his inspection. Once his inspection was completed he walked to his vehicle and spent approximately an hour on the phone and writing his estimate. When completed he walked in to our office and handed his estimate over for review. We asked Mr. Kozicki for the payment to continue with the repairs and he advised the customer requested the check sent to her residence. We explained that the proper procedure as per our Direction To Pay (DOP) within our repair contract is for the insurance company to leave a check so we can continue the repairs. Our customer handed over her original check when she dropped off the vehicle and understood any supplemental payments would be given to the repair facility. While standing at our front office we contacted our customer who advised that Mr. Kozicki called her and advised her to have the check sent to her residence and not provide the check to the repair facility until after the repairs are completed. We challenged Mr. Kozicki's intentions and questioned him about our repair authorization. He said he was doing what the customer requested. We handed the phone to Mr. Kozicki and asked him to speak with our customer in front of our counter. He advised our customer he would call her back and he walked out to his vehicle. Allstate's and Mr. Kozicki's agenda is clearly to undermine the policyholder's contractual obligation with the repair facility. Mr. Kozicki went out of his way to coerce our customer into believing it would be in her best interest to ignore the provision within the repair contract. This is a violation of state law and considered illegal activity by Allstate insurance Company and their employee. Mr. Kozicki violated state law by attempting to have our customer breach a binding contract between her and her repair facility. Please investigate our allegations and contact all individuals involved with this complaint. Mr. Kozicki did contact our customer who advised him to leave his supplemental check with the repair facility. Which he reluctantly did as our customer demanded.
