On December 13th, 2016 I was blessed to buy a 2017 Toyota Rav4 XLE AWD. One month and 4 days after that on January 17th, 2017 a nationwide policy holder backed into my vehicle damaging the passenger side door and fender. She is 100% liable and Nationwide did accept liability. When an appraiser came to look at my vehicle her estimate was using an aftermarket generic fender. I disputed the use of a generic part before she came to look at my vehicle. I am a third party claimant. I didn't sign a contract with Nationwide. I did not agree to any of their policy terms. I was under the impression that my vehicle would return to it's predamaged condition. This is a direct quote from the PA appraiser's act. (5) A description of repairs, known at the time of appraisal, necessary to return the vehicle to its predamaged condition, including labor involved, cost of all parts, necessary painting or refinishing and all sublet work to be done. " It is February 1st and I spoke to Monica's supervisor Jim Russell and Jim's supervisor John Fawcett and this situation is not resolved. I spoke with the auto body shop directly (which is one of Nationwide's preferred) and they assured me that an OEM fender is the best way to my 2017 Toyota vehicle which was 1 month old at the time of loss. I shared this information with all nationwide parties and they still refused to use the OEM part. My vehicle is still not fixed. I do not understand how I am the innocent victim of this situation and I am being told to suffer. 1 month prior to the incident my vehicle had ALL Toyota parts. Therefore a Toyota part needs to be the replacement. I spent $30,000 for those Toyota branded parts and refuse to be at a loss because Nationwide is more concerned about their bottom line than fixing my vehicle is the moral and ethical way to resolve this claim.
