Complaint Comments:
Beth Walcome inspected the loss vehicle in response to a supplement request. Part of the supplement was to eliminate the material cap of $335 from the original appraisal done by Brad Panichelli. The correct amount of refinish materials according to the Nationwide appraisal should have been $590, but Nationwide refused to pay the full amount. Ms. Walcome said that she did not have the authority to pay the full amount for the refinish materials, and that I needed to speak with her supervisor, Jim Russell, to get the material cap lifted. I called Mr. Russell at 10:50 AM and discussed the situation to no avail, despite informing him that material caps are illegal in Pennsylvania. This consistent problem was brought to the insurance department's attention in May, 2004 at a meeting between representatives from the P.C.T.G. and the insurance department. I was present at that meeting, as was Diane Koken, Ron Gallagher, and other staff members from the department. The department confirmed at that time that capping was not legal in Pennsylvania, and that a full investigation would be undertaken to ensure that the practice was stopped. It is now October, 2006, and no action has been taken. In addition, my follow-up letter on that subject, written to Diane Koken in May, 2006 has not been answered or even acknowledged to date.
