Complaint Comments:
Pennsylvania Department of Insurance: Our consumer's dropped off their damaged 2005 Chrysler Pacifica on 2-21-06 for repairs. While at our facility they provided a damage estimate from State Farm Insurance Company. We reviewed the damage appraisal and explained that if needed we would contact State Farm for a supplemental. On 2 -22-06 we dismantled the vehicle and found additional damages not covered on State Farm's appraisal. We contacted State Farm Insurance Company and requested a supplemental inspection for Mr. Miller's vehicle on 2-23-06. State Farm contacted us that same afternoon to advise a representative would be out to re-inspect for additional damages. Mr. Stewart Pague contacted our facility and requested an appointment to stop by and inspect Mr. Miller's vehicle on Friday February 23, 2006. We agreed to a time of 12:30PM. Mr. Pague did in fact visit our facility at the designated time however he advised he was to inspect a 2004 Saab belonging to another consumer prior to inspecting Mr. Miller's damage. Due to the fact we had filed a consumer's complaint with the Pa. Department of Insurance on the other consumer's vehicle and requested re-appraisal by another state licensed appraiser we advised Mr. Pague he could inspect the Miller's vehicle but not the vehicle under dispute. Mr. Pague then advised as per orders from his supervisor, a Lisa Barksdale if he could not inspect both vehicles he would not inspect any vehicles. I advised Mr. Pague that the two claims were not owned by the same consumer and represented separate circumstances and he should inspect the Miller's vehicle while he is at our facility allowing the repairs to continue however Mr. Pague refused. We asked Mr. Pague to reconsider and re-inspect the Miller's prior to leaving and he again advised he would not examine one without the other as per his supervisor's directives and he then left our facility. It is clear that Mr. Pague is in violation of the Pa. Motor Vehicle Physical Damage Appraiser Act and Regulation.
