Pa. Department Of Insurance: On March 9, 2009 State Farm appraiser James Guthrie signed in at our repair facility at 10:02 am to reimburse supplemental items required during the repair of our customer's 2005 Honda Accord Hybrid. We handed Guthrie our final repair bill and supplemental reconciliation for $2,841.13. This file of supplemental items included parts and part price increase invoices and our towing charges. Guthrie went about his business of inspecting invoices and inspecting broken and damaged parts. Guthrie photographed and documented the parts we provided for his inspection. Guthrie went to his vehicle and prepared his supplemental appraisal for the amount of $69.18. This is a difference of $2,771.95. State Farm Insurance Company through their appraiser James Guthrie denied reimbursement of $2,771.95 for the repairs of the insured's vehicle. To help the Department of Insurance better understand our situation with this appraiser we have a final invoice for said repairs of $10,973.79 and State Farm has acknowledged $8,372.40. When Guthrie was signing out of our facility @ 11:43 I asked him if he listed our towing charge on his appraisal. He said "no, as I told you before you will have to contact the claim representative." I reviewed his appraisal and our charge for towing our customer's vehicle from the accident scene was not listed. This is the sixth opportunity on the same consumer's claim that we have given State Farm Insurance Company to list incidental charges such as towing. The Pa Motor Physical Damage Appraiser Act and its corresponding Regulation does not state a repair facility is to contact an inside insurance company representative for payment of items such as towing charges. It states as follows. ' § 62.3. Applicable standards for appraisal. (a) The appraisal shall contain - Incidental charges, known at the time of appraisal, including towing, protective care, custody, storage, depreciation, battery and tire replacement. Please investigate our complaint and file enforcement actions against James Guthrie and his employer State Farm Insurance Company for noncompliance of State Law and Regulations.
